Terms of Service

1. About these terms

These Terms of Service (“Terms”) govern your access to and use of Triton, a membership management platform operated by the Triton team (“we”, “us”, “Triton”). By accessing or using Triton, you agree to these Terms. If you do not agree, do not use the service.

2. Early-access program

Triton is currently in a closed early-access program. Access is granted manually to selected gym operators. The service is provided as-is during this period. Features, pricing, and these Terms may change as the product matures. We will notify you of material changes by email.

3. Your account

You are responsible for safeguarding your account credentials and for any activity under your account. Do not share your password. Notify us promptly if you suspect unauthorized access.

4. Your data and your members’ data

Data you enter into Triton — including member records, payment information, attendance logs, and operational data — remains yours. You grant us a limited license to process it solely to provide and improve the service. You are responsible for ensuring you have the right to upload any personal information about your members, staff, or other third parties, and for providing those individuals with your own privacy notices as required by law.

5. Payments and direct debit

Triton uses third-party payment processors to help you collect payments from your members. Depending on your configuration and region, this may be Stripe (card payments) and/or GoCardless (bank direct debit, including the Australian BECS scheme). Triton itself does not store your members’ card numbers or bank-account credentials; those are handled by the processor under its own terms.

Where you collect member payments by direct debit, you are the “merchant” and, under the applicable direct-debit scheme rules, the Debit User responsible for that arrangement with your members. The processor presents the required Direct Debit Request (DDR) Service Agreement to your members during setup and sends the scheme-required confirmation and advance-notice messages on your behalf. You remain responsible for your own refund, cancellation, and dishonour policies, and for retaining direct-debit authorizations for as long as the scheme requires.

6. Telemetry and diagnostic recording

To diagnose issues and improve reliability, Triton collects technical telemetry from your browser, including error reports, performance metrics, and session recordings (visual playback of your interactions with the Triton interface). 7. Acceptable use

You agree not to:

  • Use Triton to violate any applicable law, including data protection and consumer protection laws.
  • Attempt to access another organization’s data, reverse engineer the service, or interfere with its operation.
  • Upload content that infringes third-party rights or contains malware.

8. Service availability

We work to keep Triton available but do not guarantee uninterrupted access. During early access, we may take the service offline for maintenance with limited notice.

9. Suspension and termination

We may suspend or terminate access if you breach these Terms, engage in fraudulent activity, or if continued service poses a material risk to other users. You may close your account at any time by contacting us. On termination, we will retain your data only as long as needed to comply with legal obligations.

10. Disclaimers

Triton is provided “as is” without warranties of any kind. We do not warrant that the service will be error-free or meet your specific requirements. To the maximum extent permitted by law, we disclaim all implied warranties.

11. Limitation of liability

To the extent permitted by law, our total liability arising from or related to these Terms or your use of Triton is limited to the fees you have paid to us in the twelve months preceding the event giving rise to liability. We are not liable for indirect, incidental, or consequential damages.

12. Governing law

These Terms are governed by the laws of the Republic of the Philippines. Disputes will be resolved in the courts of Metro Manila, Philippines.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use of Triton after the effective date constitutes acceptance.
